1. These terms and conditions govern the Mexicali Loyalty App.

  • (a) Your use of the Mexicali Loyalty App confirms your agreement to these terms and conditions as may be varied from time to time.
  • (b) You must comply with these terms and conditions.

2. Definitions in these terms and conditions

  • “Mexicali Loyalty App" means: The app issued by Mexicali by which discounts and rewards can be earned and redeemed.
  • "Privacy Policy" means: The Privacy Policy set out on the website: The Mexicali website at www.mexicalifresh.co.nz
  • “Rewards” means: Offers that are available to Cabana Club Loyalty programme members including annual birthday rewards.
  • ”Promotions” means: Coupons and discounts exclusive to Cabana Club Loyalty programme members via the App and online ordering.

3. Participation

  • (a) To participate in the Cabana Club Loyalty programme you must obtain a Mexicali Loyalty App from the Apple App Store or Google Play Store. Only individuals may participate in the Cabana Club Loyalty programme. You may not transfer your Mexicali Loyalty App or rewards to another individual.
  • (b) You must register and activate your Mexicali Loyalty App online to be able to redeem Promotions and Rewards.

4. Personal information about you

  • (a) Personal information about you may be collected and held on behalf of Mexicali in accordance with the Privacy Policy. Any information collected and held may be used from time to time to administer the Cabana Club Loyalty programme; provide you with services, for marketing and promotional purposes and for other reasons set out in the Privacy Policy. Under the Privacy Act 1993, you have rights of access to, and correction of, any personal information held by us.
  • (b) If you have provided us with an email address or a phone number, you agree that we may send you emails or text messages for any of the purposes set out in clause 4 (a) above or the Privacy Policy.

5. Lost or stolen phone or device

  • If you have a lost or stolen phone or device with the Mexicali Loyalty App installed, you must immediately deactivate your App by notifying us so that we can do so on your behalf. To replace the lost or stolen Mexicali Loyalty App you need to:
  • (a) Obtain a new device to install the App onto
  • (b) Contact us to obtain your previous account information.
  • (c) We are not responsible for any loss to you arising in relation to a lost or stolen phone or device.

6. To earn Stamps on your Digital Loyalty Card:

  • (a) Once you have registered and activated your Mexicali Loyalty App online you can start collecting Stamps on your Digital Loyalty Card
  • (b) Collect one Stamp each time you purchase a regular burrito of any value instore, online or via the App.
  • (c) Collect a Stamp instore by; (i) Scanning your App at point of purchase (ii) Logging into your Cabana Club Loyalty account online when making a purchase (iii) Making a purchasing using the Mexicali Loyalty App
  • (d) Stamps are valid with any regular burrito purchase.
  • (e) Stamps are not valid with mini burrito purchases.
  • (f) One stamp can be collected per regular burrito, per transaction.
  • (g) Once 10 stamps have been collected, redemption of the 11th regular burrito will be free of charge and can be redeemed by clicking the ‘redeem’ button in your Mexicali Loyalty App, or ordering logged into your account online, or by scanning your App instore.
  • (h) Only one free regular burrito can be redeemed at any one time.
  • (i) Stamps expire 12 months after the first stamp has been collected.
  • (j) Stamps cannot be transferred to any other loyalty member account.
  • (k) Stamps cannot be refunded for cash or exchanged for any other menu item.

7. Stamp collection

  • (a) The balance of Stamps held on the Digital Loyalty Card in your Cabana Club Loyalty account can be checked at any time in a participating Mexicali store, logging into your account on online ordering, or via the App.

8. Expiry of Stamps

  • (a) Stamps expire 12 months after the date of which the first stamp was earned.

9. Birthday reward

The birthday reward is one free taco of your choice with a spend of $10.
The reward is available at the beginning of the customers birthday month.
Valid for redemption via the App or online only.

Valid within the birthday month of the customer and expires thereafter.
Birthday rewards cannot be redeemed instore.
Only one birthday reward can be redeemed per customer, per birthday month.
Rewards are not transferrable, refundable or exchangeable for any other product or cash.
To qualify for a birthday reward you must:

Be registered as a Cabana Club Loyalty Member before your birthday month.
Make a minimum of 2 orders in the last 12 months.
Spend a minimum of $10 to redeem.
The customer birth date must be entered into their Cabana Club Loyalty account before their birth month.
Must be registered for push notifications and the mailing list to be notified and communicated to.

Rewards can be checked by logging into a customer loyalty account or through the Mexicali App by selecting ‘Account’ and ‘Communications’.

10. Promotions

A promotion is a digital coupon that can be redeemed online or via the Mexicali App which provides a discount or reward with purchase.
Promotions can be redeemed by ‘adding to cart’ in the order menu
Terms and conditions are attached to each promotion and published on each offer.

These can be used for pick-up and delivery orders via our Mexicali App only.
Not valid on any other delivery service outside of the Mexicali App, and not valid instore.
Promotions are issued for customers based on their current RFM score and not all promotions will be visible to all customers at any one time.

11. Liability

We are not liable for:

  • (a) A delay in supplying replacement login information for your Mexicali Loyalty App;
  • (b) Unauthorised use of your Mexicali Loyalty App;
  • (c) Failure by you to notify a participating store that a purchase is a Mexicali Loyalty App transaction;
  • (d) Failure to notify you of any changes to these terms and conditions;
  • (e) Any error, misstatement or omission in the information and content contained on the Website;
  • (f) Claim arising from or relating to expiration of the Cabana Club credit/points loyalty system.

12. Termination

  • (a) We reserve the right to suspend or terminate the Cabana Club Loyalty account at any time, in our sole discretion without prior notice.
  • (b) In addition to our right to terminate or suspend the Cabana Club Loyalty account at any time, we may terminate your Mexicali Loyalty App account at any time without prior notice should:
    • (i) You fail to comply with these terms and conditions; or
    • (ii) Your Cabana Club Loyalty account is not used for a period of 6 months;
  • (c) Upon termination of your Cabana Club Loyalty account you will not be able to redeem any stamps, discounts, promotions or rewards which might otherwise have been available to you.
